These Terms of Service ("Terms") govern your access to and use of all websites, applications, and services operated by Island Pitch LLC ("Island Pitch," "we," "us," or "our"), a company based in Long Beach, California. By accessing or using any of our properties, you agree to be bound by these Terms.

Paid services are billed through Stripe. Pricing, refund policies, and subscription terms are presented at the time of purchase.

Voice Cloning Consent (Match My Vibe)

By using Match My Vibe, you consent to having your voice captured and processed in real time for the purpose of creating a temporary voice clone. You acknowledge that:

• You are providing your own voice voluntarily and have the right to do so
• Your voice is processed by third-party AI services (Cartesia AI, Anthropic, ElevenLabs) during the session
• Voice data is not stored on our servers after the session ends
• You may optionally save generated audio to your own device
• You will not use generated voice clones for impersonation, fraud, or any unlawful purpose

Acceptable Use

You agree not to use any Island Pitch service to:

• Impersonate any person or entity, or create deepfakes of others without consent
• Engage in fraud, harassment, or any illegal activity
• Distribute malware or interfere with the operation of our services
• Circumvent access controls, rate limits, or usage restrictions
• Scrape, reverse-engineer, or attempt to extract source code from our platforms
• Use generated voice clones in a manner that could harm, deceive, or defame others

We reserve the right to suspend or terminate access for violations of these Terms.

Intellectual Property

Island Pitch owns all rights to our platforms, software, branding, content, and proprietary technology, including DYKWYBLS, NextWave, Match My Vibe, and LearnAI.

You own your data, content, and voice recordings. By using our services, you grant Island Pitch a limited, non-exclusive license to process your data solely to provide the requested service. We do not claim ownership of your content or voice.

Third-Party Services

Our services rely on third-party providers. Your use of our services is also subject to their respective terms:

• Amazon Web Services (AWS) — cloud infrastructure, authentication (Cognito), storage, compute
• Cartesia AI — voice synthesis
• Anthropic — AI processing
• ElevenLabs — conversational voice AI
• HubSpot — CRM and marketing
• Stripe — payment processing for paid services

Accounts

Some services require an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at legal@islandpitch.com if you suspect unauthorized access.

Disclaimer of Warranties

ALL ISLAND PITCH SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ISLAND PITCH LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ISLAND PITCH IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

Indemnification

You agree to indemnify and hold harmless Island Pitch LLC from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of our services or violation of these Terms.

Governing Law & Jurisdiction

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Los Angeles County, California.

Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on our properties with a revised "Last updated" date. Your continued use of our services after changes are posted constitutes acceptance of the updated Terms.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
